GENERAL TERMS AND CONDITIONS FOR THE ONLINE RETAIL ACTIVITIES

1. SCOPE OF APPLICATION
The following general terms and conditions in their respective version, valid at the time the order is placed, shall apply exclusively for our services and deliveries within the scope of this online shop. We do not recognize deviating terms and conditions of the ordering party unless we have expressly agreed to their validity in writing.
2. CONCLUSION OF THE AGREEMENT
Our offers on the Internet constitute a non-binding invitation to conclude a purchase agreement. With his or her order, the customer submits a binding offer to conclude a purchase agreement. The agreement shall come about once we accept the offer – either by sending the goods or issuing a confirmation of order. Automatically sent confirmations regarding the receipt of an order serve only to inform the customer and do not constitute acceptance of agreement.
All prices are quoted in euros for EU and in GBP for UK and include sales tax, exclusive of indicated shipping and packaging costs.
4. CANCELLATION POLICY
Right of Cancellation
You may cancel your agreement within two weeks in writing (e.g. letter, fax, e-mail) without stating any reasons or, if the item has already been delivered to you prior to the expiration of the cancellation period, by returning the item. The cancellation period begins following the receipt of this policy in writing, but not prior to the receipt of the goods by the recipient (for recurring deliveries of similar goods, not prior to the receipt of the first partial delivery) and not prior to fulfillment of our duty to provide information. Consequences of Cancellation
In the event of an effective cancellation, both parties must return any received payments or goods and relinquish any benefits they may have received. If you are unable to return the received goods in whole or in part or can only return them in deteriorated condition, you may have to compensate us for these damages. This does not apply if you are returning merchandise whose deteriorated condition is exclusively due to the inspection of the goods as may have been possible in a store. Furthermore, you may avoid having to compensate us for the deterioration resulting from the intentional use of the item by not using the item as if it were your own and refraining from all acts that might affect its value. Goods suitable for shipment by parcel post are to be returned at our risk. The costs for returning the consignment shall be at your expense if the delivered goods correspond to your order and if the price of the returned item does not exceed 40 EUR/ 35 GBP . The return shipping costs shall also be at your expense if the price of the item was higher than 40 EUR/ 35 GBP and full payment or a contractually agreed partial payment has not been made at the time of cancellation. Otherwise, you shall not incur any expenses for the return shipping of goods. Goods that cannot be shipped by parcel post shall be collected. Payment reimbursement obligations must be met within 30 days. This 30-day period shall commence for you upon mailing your cancellation letter or the item, and for us upon its receipt.
End of the Cancellation Policy
We deliver exclusively to addresses within EU and UK. The delivery shall be made from our distribution center to the address specified by the customer.
Partial deliveries are permissible. In the event of partial deliveries, we shall bear the additional shipping costs incurred as a result of this.
6. DUE DATE, PAYMENT, ARREARS
The purchase price is to be paid by credit card prior to delivery.
If the amount payable is rejected by the account-managing bank and is not paid within 30 days, the customer shall automatically be in arrears.
If a customer is in arrears, we are entitled to demand interest on arrears in the amount of 5 percentage points above the respective base rate of the European Central Bank.
7. WARRANTY, NOTICE OF DEFECTS
SIGG warrants the SIGG bottles to be free from any defects in material or workmanship at the moment of delivery to the buyer. During a period of two years as of the date of purchase we will replace (subject to design availability) any product component part that fails to conform to this warranty within 30 days after its receipt by the service departments. In no event will SIGG be liable for incidental, consequential or special damages. This is a factory guarantee. Do not return this product to the retailer. Send defective product directly to the SIGG representative in your country of domicile.
8. RETENTION OF TITLE
We shall remain the owner of the goods that we delivered until complete payment of the purchase price has been made and any claims resulting from the delivery agreement have been settled. The buyer is not permitted to freely dispose of the reserved goods (e.g. sale, pledging, collateral assignment, giving as a gift, lease).
If the buyer has undertaken a disposal of the purchased item in violation of the agreement, the paid or yet to be paid purchase price or other received or yet to be received payments by the acquiring party shall take the place of the goods. The buyer here and now assigns all claims from this possible disposal to us. The buyer is not authorized to collect these claims. Within the scope of the assignment, the buyer is to cooperate by disclosing the assignment to the acquiring party and arranging for this party to pay us as the supplier.
In the event that the goods are seized from the buyer, we are to be notified – by sending a copy of the foreclosure decree and an affidavit – that the seized goods are reserved goods delivered by us.
The assertion of our rights arising from the retention of title does not release the buyer from his or her contractual obligations. The value of the goods at the time of their return will solely be offset against our existing claims against the buyer.
For legal matters within the scope of this online shop, German law applies to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
10. DATA PROTECTION POLICY
We declare that, for the purpose of protecting your personal data, we shall always collect, store, modify, transmit, block, delete and use your personal data in accordance with the applicable data protection regulations and other legal provisions.
Your personal data shall only be disclosed to those third parties that are involved within the scope of carrying out the agreement in their capacity as service partners, such as for example the logistics company charged with the delivery of the goods. In cases where your personal data are disclosed to third parties, the scope of transmitted data shall be limited to the required minimum.
By concluding this agreement, you agree to the collection, processing and use of your personal data in accordance with the information stated above. You are entitled to request details of your stored personal data free of charge. You also have the right to cancel your consent to the future storage of your personal data at any time. In the event of such a cancellation, your personal data shall be deleted unless they are still required for the fulfillment of contractual obligations or unless legal provisions prohibit such a deletion.
